TERMS & CONDITIONS

GENERAL

All orders accepted and work undertaken by Calista & Belle is on the understanding that the client has read and agreed to Calista & Belle’s Terms and Conditions. It is therefore the client’s responsibility to check these Terms and Conditions before entering into a contract with Calista & Belle. All designs are the property and copyright of Sophie Beattie at Calista & Belle and may not be reproduced by yourself or any third parties.

Calista & Belle reserve the right to use any of your stationery to promote our products and services, however, we will never share any of your personal information with third parties. If you would prefer your stationery to not be used by Calista & Belle please discuss directly with Calista & Belle.

COPYRIGHT

Sophie at Calista & Belle shall retain ownership of the copyright of the Artwork and any preliminary sketches, drafts and alterations including images shared electronically. Retention of copyright includes all reproduction rights, licensing rights, and the right to claim statutory copyright. The designs (or parts thereof) may not be reproduced by the Client without prior written approval from Sophie at Calista & Belle.

REPRODUCTION

Callisto & Belle retains the right to license reproductions of any artwork for UK or Worldwide use. No reference will be made to the Client’s name or personal information.

Any unauthorised reproduction of part or all of its contents is strictly prohibited and is protected by international copyright laws. Any improper or illegal use of the stationery, artwork or designs will be pursued.

DISPLAY

The Client hereby allows Calista & Belle to display the artwork in the Calista & Belle’s portfolio, literature, website and advertising, including all forms of social media. Where the Client has their own presence on social media, a direct link may be used to reference the client unless anonymity has been previously agreed.

BOOKING STUDIO SPACE

If you wish to pre-book studio time for a future date. You can reserve your studio time by paying a £100 deposit (non-refundable on cancellation) which will be deducted from your final payment. This deposit will guarantee that you have your studio time reserved with Calista & Belle. Calista & Belle will advise on the time frame for your stationery reservation. If you need to move this time frame, this will need to be agreed upon by Calista & Belle within 4 weeks before your agreed reserved dates. If for any unforeseeable reason covered in the Liability section Calista & Belle can not fulfil your booking your deposit will be refunded in full and guidance will be given on finding a suitable alternative supplier.

 

If your stationery is quoted on at point of taking the studio booking deposit prices are subject to change due to cost rises from our supplier chain that are out of our control. Any changes will be discussed with you.

PAYMENT TERMS

Final price will be decided by the parties per individual commision. Parties will agree to price in writing prior to the commencement of the commision.

 

On booking with Calista & Belle a 50% of the total quoted cost will be required as a deposit to secure your commissions design and studio date. When the booking form is issued your date will be reserved for 10 days, after this time Calista & Belle can not guarantee you will be able to book this date. If for any reason you require more time to make a decision please contact Calista & Belle directly and I will endeavour to accommodate your time schedule within reason.

 

A deposit of 50% of the agreed final price is required before work commences. The deposit is non-refundable unless the Calista & Belle is unable to start the commission.

Final payment of the remaining balance (plus any delivery/travel costs) is due on completion of the commision before printing. If any additional charges are agreed during the design process these costs will be reflected in the remaining balance.

Once payment has been taken for either your deposit or full order, you have agreed to adhere to and bound you in contract to Calista & Belle’s full Terms and Conditions.

PROOFS AND FINAL APPROVAL

Unless otherwise agreed, Calista & Belle will provide an electronic version of initial artworks and colour references in order that the client can input on amendments to the artwork before completion of final artwork.

All proofs will be sent by email unless otherwise requested. Calista & Belle take great care and time to ensure all information on your commision is accurate, however, it is the responsibility of the client to proof-read and check the spelling, grammar and layout of the design before giving Calista & Belle final approval and instructions to print. I will ask you to send me your wording and then copy and paste it into your designs. It is therefore the responsibility of the client to ensure the final design proof is correct before giving instruction to print.

Calista & Belle do not take responsibility for any designs which are signed off and subsequently printed with typing or layout errors and will therefore not be liable for any resulting costs or reprints. Calista & Belle, therefore, advise that you check your proofs carefully and perhaps ask someone else to cast their eyes over it as well.

When scheduling your print with the printers I will supply you with a print deadline date and time for the artwork to be signed off by you. Unless your wedding/event has been cancelled due to reasons beyond your control or you have discussed with me before this date that you can not reach this deadline, this date can not be moved. Changes to quantities or additional items can also not be added at this stage unless previously discussed with me before I have scheduled the work with the printers.

On final proof approval, your quoted balance will be required in full before your items are sent to print and posted out to you. Calista & Belle can not be held responsible for late delivery if you have failed to pay your full balance by the required date.

AMMENDMENTS

If the client changes the brief or requires substantial changes, additions or variations, Calista & Belle may require additional payment for such work. This will be agreed upon before proceeding with such changes.

RIGHT OF REFUSAL

It is the intent of this contract that Calista & Belle creates an original artwork for the Client, that the Client will purchase on the terms hereof. However, if, after the artwork is completed, the Client elects not to purchase the artwork, Calista & Belle shall retain title to the artwork and shall have the right to retain the deposit, and the Client will owe no additional fees to the artist.

CANCELLATIONS AND POSTPONEMENTS

In the event of a wedding postponement, if the design process is still at an editable stage your new wedding date can be applied to your design free of charge, details of this can be discussed personally between Calista & Belle and the client.


In the event that your wedding date is cancelled or postponed after your ‘Save the Date’ ‘Wedding Stationery’ or ‘On the Day’ items have been fully paid and sent to print, Calista & Belle, unfortunately, can not offer a refund. If your wedding has been postponed due to events out of your control please contact us directly and we will endeavour to accommodate a reprint for your new date. Alternatively, I can supply a digital amendment free of charge.

Please note: If the new date is over 12 months after the original wedding date or an increase in items required an additional charge may incur for the rising cost in suppliers/printers costs, if this happens we will discuss this with you directly.

LEAD TIMES

All designs are currently bespoke, please allow 8-10 weeks from initial contact to delivery. These times allow up to 3 weeks for print and delivery to you. Quick responses to correspondences from Calista & Belle will endeavour to shorten these time scales.

‘On the day’ items must be approved at least 4 weeks before the wedding to ensure delivery on time. Calista & Belle will not be liable for orders not delivered on time if this time scale is not met.

If the client needs a quicker turnaround, please contact Calista & Belle before placing the order. Calista & Belle will always try to accommodate tighter timescales if possible, but some schedules may incur a rush fee and increased delivery fee.

All design and print quotes are valid for 30 days. Reserved design slots are only held for 10 days from when your booking form is sent. After this time period if the contract has not been signed and 50% deposit paid we can not guarantee the availability of this design slot.

DELIVERY

Delivery will be via Royal Mail Special Delivery unless otherwise agreed. Artist accepts no responsibility for items that become lost or damaged in transit. If the artwork is irretrievably lost or damaged, the client must inform the Artist within 24 hours of receipt

or intended receipt.

 

In this event the client is entitled to receive a full refund or replacement artwork subject to Artist availability. The risk in the Artwork shall pass to the Client on completion of delivery. Title to the Artwork shall not pass to the Client until the Artist receives payment in full (in cash or cleared funds) for the Artwork.

RETURNS

We currently only offer a bespoke service and all items are non-cancellable and non-refundable unless faulty.

We try very hard to ensure that you receive your order in pristine condition. In the unlikely event that the product arrives damaged or faulty, please contact us immediately, this will be given special priority and you can expect to receive the correct item within 72 working hours (this timescale may be longer if the item is personalised and requires a reprint). Any incorrect items received all delivery charges will be refunded back to you.

On personalised goods Calista & Belle will make all reasonable efforts to check content supplied, but any spelling/grammar/contact details will be the responsibility of the client to approve the supplied digital artwork before designs are sent to print. After digital artwork has been approved and sent to print NO amends or refunds can be issued.

LIABILITY

If Calista & Belle fail to deliver the order for any reason other than an event/reason beyond Calista & Belle’s reasonable control, or through the fault of the client and Calista & Belle is liable to the client. Calista & Belle’s liability shall be limited to the invoice price of the goods.

Calista & Belle shall not be liable to the client or be deemed in breach of the agreement by reason of any delay in performing, or any failure to perform any of Calista & Belle’s obligations in relation to the goods if the delay or failure was due to any cause beyond Calista & Belle’s reasonable control. Without prejudice to the generality of the foregoing, the following shall be regarded as causes beyond Calista & Belle’s reasonable control:

  • Act of God, explosion, flood tempest, fire or accident, pandemic

  • War or threat of war, sabotage, insurrection, civil disturbance or requisition.

  • Acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of governmental, parliamentary or local authority

  • Import or export regulations or embargoes

  • Strikes, lock-downs or any other industrial actions or trade disputes (whether involving employees of Calista & Belle or of a third party)

  • Difficulties in obtaining raw materials, labour, fuel, parts, or machinery.

  • Power failure or breakdown in machinery.

COMPLAINTS

The Client shall make an immediate objection upon delivery if the commision is not in accordance with the approved design. If such objection is not received by Calista & Belle within 7 days of delivery of the items it shall be deemed that the items are acceptable.

In the unlikely event that you have a complaint, please contact us in the first instance so we can respond appropriately and try to resolve your issue.
